What Is the Limitation Period for Applying for Labor Arbitration?

The limitation period for applying for arbitration of a labor dispute is one year, calculated from the date on which the party knew or should have known that its rights had been infringed.

The limitation period is interrupted when one party asserts its rights against the other party, requests relief from a competent authority, or the other party agrees to perform its obligation. A new limitation period begins from the time of interruption.

Where force majeure or another legitimate reason prevents a party from applying for arbitration within the limitation period, the period is suspended and resumes when the cause of suspension is eliminated.

During an employment relationship, an employee’s arbitration claim concerning unpaid labor remuneration is not subject to the above limitation period. If the employment relationship has ended, the claim shall be filed within one year after termination.
